Take-Two's GTA 6 Subpoenas Don't Name a Leaker Yet

Take-Two filed DMCA subpoena petitions in the Southern District of New York on 20 August, seeking identifying records from Microsoft and Discord by 4 September. The filings follow the spread of unauthorized Grand Theft Auto 6 clips, but nobody on the docket is named or charged as the leaker.

What the petitions actually ask

According to Kotaku's filing recap, Take-Two is seeking to identify alleged infringers who distributed copyrighted "audiovisual content, artwork, images, dialogue, or other creative elements."

Microsoft must provide internal investigative records tied to the leaker persona, alongside account IDs, registration emails, login IPs, phone numbers, device identifiers, and OneDrive storage containing Rockstar assets from 1 June 2026 onward. Discord faces identical requirements for accounts present in specified rooms, including a public Odyssey guild and a community server tied to Matthew "DarkViperAU" Judge.

A named Discord is not the target

Judge stated publicly that while Take-Two requested logs from his server, no leaked clips were hosted in his channels and Rockstar has not contacted him directly. He speculated the leaker may have joined after he mocked their driving skills on stream.

In civil discovery, subpoenaing a server functions like pulling security footage from a public street: Discord holds the connection logs, but server owners are not accused of the breach. Framing Judge as the leaker confuses a data request with an indictment.

Status of the investigation

The 4 September deadline requires platforms to produce data, not announce arrests. Studio reporting indicates Rockstar still has not confirmed who gained initial access. Until Microsoft and Discord return records and court filings name a specific individual, the docket represents an active information hunt, not an identified culprit.
